In most cases the basement will extend to the footprint of the building but in some blocks the basement may extend beyond the footprint and under adjoining buildings. What are the implications for blocks seeking their right to manage?<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph --><!-- \/wp:paragraph -->\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-839dd96 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"839dd96\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-47f9df7\" data-id=\"47f9df7\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-8cadba9 elementor-widget elementor-widget-text-editor\" data-id=\"8cadba9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The 2002 Act does not make specific reference to basements. The most relevant part of the statute is s.72, which stipulates that Right To Manage is only available to a self-contained, structurally detached building or a self-contained part of a building. Much legal debate has focused on the meaning of \u2018structurally detached\u2019.\u00a0<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:paragraph --><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-7651ad7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7651ad7\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b4de0e9\" data-id=\"b4de0e9\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-9abffce elementor-widget elementor-widget-text-editor\" data-id=\"9abffce\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>In a recent Court of Appeal Decision (<em>LM Homes v Queen Court Freehold Co Ltd [2020] EWCA Civ 371<\/em>) it was confirmed that the area of a building is not limited to the structure above ground level but includes all parts below it, including the floor slab at podium level, the area of basement immediately below the block, the relevant part of the basement floor slab and the subsoil beneath.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0402f92 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0402f92\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f13a992\" data-id=\"f13a992\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1a2357d elementor-widget elementor-widget-text-editor\" data-id=\"1a2357d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The starting point in defining \u2018structurally detached\u2019 is a 1974 House of Lords case in the context of the 1967 Act, (<em>Parsons v Gage [1974] 1 WLR 435 HL<\/em>), in which Lord Wilberforce discounted the significance of the adverb \u2018structurally\u2019 and took the view the term meant no more than \u201cdetached from any other structure\u201d.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-62a4ba4 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"62a4ba4\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-953b835\" data-id=\"953b835\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4269676 elementor-widget elementor-widget-text-editor\" data-id=\"4269676\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The first meaningful case in relation to the 2002 Act came before the Upper Tribunal in 2013 (<em>No 1 Deansgate (Residential) Ltd v No 1 Deansgate RTM Co Ltd [2013] UKUT 0580 (LC))<\/em>, which decided the Wilberforce definition was not intended to apply generally and would lead to absurd consequences if applied to s.72. It would effectively mean one could connect a washing line between two buildings and they would disqualify for Right To Manage because they were attached.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-6d1bab7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"6d1bab7\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b926328\" data-id=\"b926328\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e8d3c67 elementor-widget elementor-widget-text-editor\" data-id=\"e8d3c67\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The Deansgate case was about shared guttering between two otherwise detached buildings. The Upper Tribunal decided that the adverb \u201cstructurally\u201d was there for a purpose, otherwise the draughtsman would have just used \u2018detached\u2019 or \u2018wholly detached\u2019. It determined that attachment to another building was permissible as long as the attachment was \u2018non-structural\u2019.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-afab3ed elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"afab3ed\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-49c4c79\" data-id=\"49c4c79\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-62a8290 elementor-widget elementor-widget-text-editor\" data-id=\"62a8290\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The following year a contrasting case (<em>Albion Residential Ltd v Albion Riverside Residents RTM Co Ltd 2014 UKUT 6 (LC))<\/em> was heard by the Upper Tribunal. The riverside building was described as a \u201cstructurally complex modern building\u201d with an underground car park that extended beneath an adjoining block. On the basis of expert engineering evidence the tribunal\u00a0determined that various parts, including riverside buttressing, were structurally dependent on one another and therefore not \u201cstructurally detached\u201d. Right To Manage was disallowed.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-20c0fdb elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"20c0fdb\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-6e4b8f3\" data-id=\"6e4b8f3\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3cd272e elementor-widget elementor-widget-text-editor\" data-id=\"3cd272e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The nearest we have come to specific guidance is in a 2018 case (<em>CQN RTM Company Limited\u00a0v Broad Quay North Block Freehold Ltd [2018] UKUT 183 (LC))<\/em> in relation to the Radisson Tower and adjoining blocks in Bristol. In this case the Judge set out alternative propositions, the primary one being that \u201c<em>structural, in this context should be taken as meaning \u2018appertaining or relating to the core fabric of the building\u201d<\/em>. The Judge also determined there would be no structural detachment \u201c<em>if one bears part of the load of another or there is some other structural interdependence between them<\/em>\u2026\u201d.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-52c074b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"52c074b\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-aaf058b\" data-id=\"aaf058b\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-8cabb2e elementor-widget elementor-widget-text-editor\" data-id=\"8cabb2e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>A more recent High Court decision (<em>Consensus Business Group (Ground Rents) Ltd v Palgrave Gardens Freehold Co Ltd [2020] EWHC 920 Ch<\/em>) has questioned these propositions and adopted a slightly different approach. Mrs Justice Falk said \u201c<em>I do not agree with the submission that the question of structural detachment is simply one for structural engineers and dependent solely on the existence or otherwise of structural interdependence or load bearing connection. This is not the statutory test<\/em>. <em>I would also add that I consider that design and function play some part in determining whether structural detachment exists.<\/em>\u201d\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0e18654 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0e18654\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-7614cbb\" data-id=\"7614cbb\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d7bb4a1 elementor-widget elementor-widget-text-editor\" data-id=\"d7bb4a1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>In Palgrave Judge Falk took into account that the blocks were all constructed at the same time and a \u2018single built structure\u2019 extended under each one. Furthermore there was direct lift and stair access between the underground structure and each Block. She placed weight on the observations of the Recorder in the County Court, where he found as a matter of fact that there was<em> \u201da single, coherent structure, which was built as a part of a single development, with a common car park, which was used to its full extent by residents of all the Blocks. This was not a case of buildings that were separately designed and built to function independently<\/em>.<em> The facts are different from Deansgate and closer to CQN and Albion Riverside<\/em>.\u201d\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-9a8cca2 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"9a8cca2\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-89f9d7e\" data-id=\"89f9d7e\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b09e674 elementor-widget elementor-widget-text-editor\" data-id=\"b09e674\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Mrs Justice Falk also made reference to Lord Millet (quoted in LM Homes) where he said \u201c<em>The Courts will presume that Parliament did not intend a statute to have consequences which are objectionable or undesirable; or absurd; or unworkable or impracticable, or merely inconvenient; or anomalous or illogical; or futile or pointless.<\/em>\u201d<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d7a196a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d7a196a\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-74c4e62\" data-id=\"74c4e62\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-deda84f elementor-widget elementor-widget-heading\" data-id=\"deda84f\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">CONCLUSION<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b10e9d8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b10e9d8\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b347924\" data-id=\"b347924\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-769eb0e elementor-widget elementor-widget-text-editor\" data-id=\"769eb0e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The general approach adopted by the courts and tribunals seems to be that whether a building meets this criteria is a question of \u2018fact and degree\u2019, which is not very helpful to RTM practitioners seeking to advise clients on a building\u2019s RTM prospects. To date no specific \u2018tick-box\u2019 test exists.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b06c785 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b06c785\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-fb19d3b\" data-id=\"fb19d3b\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-fce3a56 elementor-widget elementor-widget-text-editor\" data-id=\"fce3a56\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Although Palgrave Gardens appears to be a move towards a more common sense, holistic approach to this issue, it is difficult to see how the expert evidence of architects and structural engineers can be completely disregarded. Until or unless the Court of Appeal reviews these issues, future tribunals are likely to base their decisions on the aforementioned legal authorities.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-eb8ad34 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"eb8ad34\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-dd9999e\" data-id=\"dd9999e\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4d4ff0f elementor-widget elementor-widget-text-editor\" data-id=\"4d4ff0f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>In broad terms, if your building has a basement or underground car park that extends beyond the buildings footprint and underneath another building or buildings it may be an obstruction to an RTM claim.
